At Eric Cuellar Law, we believe that an informed client is a confident client. That’s why we created a comprehensive resource library covering virtually every major topic in personal injury law in Texas. Whether you’re just starting to explore your rights or you’re ready to move forward with a claim, you’ll find plain-English explanations, case timelines, and strategic advice.

Personal injury law falls under the broader category of tort law, which deals with civil wrongs that cause harm or loss to another person. Its primary purpose is to provide compensation to individuals who have been injured or suffered damages due to someone else’s careless or wrongful conduct.
Unlike criminal law, where the state prosecutes offenders to impose punishment, personal injury law focuses on restoring the victim—financially and, as much as possible, physically and emotionally—to their pre-accident condition.
In everyday life, personal injury claims can arise from a wide range of incidents—such as car or truck accidents, slip and fall injuries, dog bites, or cases of medical malpractice. While each state has its own specific laws and procedures, most personal injury cases share a common foundation: the injured party must prove that the other person or entity was negligent and that this negligence directly caused the harm.

A personal injury case arises when someone is hurt because of another person’s negligence, recklessness, or intentional act. In Texas, this can include car accidents, slip and fall incidents, dog bites, workplace injuries, or medical malpractice. The goal is to recover compensation for losses caused by the injury.
Texas follows a modified comparative fault system. This means:
— Each party’s degree of fault is measured as a percentage.
— if you are found to be more than 50% at fault, you cannot recover damages.
— If you are 50% or less at fault, your recovery is reduced by your percentage of fault.
For example, if your damages are $100,000 but you are 20% at fault, you could recover $80,000.
The timeline varies based on the complexity of the case:
—Minor accidents with clear liability: a few months to settle.
—Serious injuries or disputed liability: 1–2 years or longer.
Factors affecting the timeline include: insurance company negotiations, medical treatment completion, evidence gathering, and whether the case goes to trial.
You don’t have to hire a lawyer, but having one is strongly recommended:
Insurance companies often try to minimize payouts.
—Insurance companies often try to minimize payouts.
—Lawyers can help calculate the full value of your claim, including future medical costs.
—Legal representation ensures you don’t accidentally accept a settlement that’s too low.
Under Texas law, being partially at fault does not automatically prevent recovery.
—Your damages are reduced by your percentage of fault.
—Example: You are 30% at fault and your total damages are $50,000. You could recover $35,000.
The statute of limitations is the deadline to file a lawsuit:
—Personal injury cases: 2 years from the date of the accident.
—Property damage cases: 2 years from the date the damage occurred.
Missing this deadline usually means you lose your right to sue.
In Texas, you may recover both economic and non-economic damages, including:
—Medical expenses (past and future treatment)
—Lost wages or reduced earning capacity
—Property damage
—mental anguish
—Pain and suffering
—In some rare cases, punitive damages if the other party acted with gross negligence or intentional harm.
